Such property items are evaluated at their current resale value and not what you originally paid while purchasing them.

Bad Collateral:

A house that is still on a mortgage or that you’re paying the EMIs for. That can be considered but it takes some time to evaluate the property value and it may increase the time of paperwork.

Additionally, any item that you’ve purchased on loan or credit and in which the lender has the hold are considered as Bad Collateral.

When am I eligible to get my collateral back?

You can receive it back when the court case is complete.

Generally, this happens when:

  1. The charges are dropped or
  2. The person is found innocent at trial or
  3. The person is sentenced to probation/jail time.
